Chairman Richards called the meeting to order at 6:31.  Roll call was taken.  Those present were:

Grand Mound joined the meeting late.

 

DeWitt made a motion to approve the minutes of the June 8, 2006 meeting.  Clinton seconded the motion.  Motion unanimously carried.

 

AUDIENCE COMMENTS  Tom Goldensoph councilman from Low Moor wanted to know more about the options from the meeting that took place with Allied Waste and the four entities.  Lewis Todtz the representative from Clinton County said that those options were 1. Buying, 2. Allied using the landfill with the agency retaining control, 3. A commercial hauler rate for Allied, 4. or a transfer station being set up at the landfill.  Goldensoph mentioned he found from Allied Waste’s website, that they own 169 landfills and that the average life of one of their landfills is 30 years.   With our current tonnage the expected life of our landfill is 160 years.  Goldensoph also mentioned that if Allied uses the landfill, that the road through Low Moor will have a lot more truck traffic and he wondered where would the money come from for road maintenance.

 

Delmar made a motion to approve the unanimous consent calendar.  Clinton seconded the motion.  Motion unanimously carried.

 

DIRECTOR OF OPERATIONS AND EDUCATION REPORT

EDUCATION: 

1.      The Enviro Kids program will start this Saturday.  Right now there are 42 signed up for the program that will run every other Saturday until September 9.  Five programs are planned.

 

RIVERBOAR DAYS – IOWA DNR TRAILER:  The Iowa DNR trailer was at Riverboat Days with interactive games and displays.  700 visited the trailer.  The trailer will also be at the Jackson County Fair.

 

RCC:  Jones County had a Farm- A- Cyst program that was held last week.  This program would be a good program in the future for Clinton County.

 

LANDFILL RULES CH. 113.:  The newest draft has been issued and comments can be directed to the Iowa DNR.  

1.      IOWA DNR LETTER TO EPA : A letter was sent to the EPA asking for clarification on the abutment liners and written confirmation on the alternative liners.

 

E.     IOWA DNR RULES FOR COMP PLAN AND PLANNING UPDATE  A letter signed by James E. Brick was sent to the Iowa DNR asking if they intend to comply with the Iowa Code, as well as the 2000 Attorney General’s opinion, in regard to the fact that transfer stations are sanitary disposal projects, and thus they need to submit a comprehensive plan to the DNR.  Also that one’s comprehensive planning area should not overlap with another’s comprehensive planning area.  The DNR currently does not enforce these requirements with transfer stations that export 100% of the waste they received.  This letter is asking the Iowa DNR to confirm in writing that they intend to comply with the law and require all transfer stations to meet the provisions of the Iowa Code.

 

Liegois sent a letter from CCASWA to the DNR stating that we agree with the letter sent by Jim Brick regarding the issue of the sanitary disposal projects.

 

ENGINEER SITE REPORT  C.J. Lage of Barker Lemar reported:

A.     SUBTITLE D LANDFILL CELL DESIGN UPDATE:  The design was submitted on July 6, 2006 to DNR.  Lage should have a report back by August.   

B.    EXCAVATION WORK FOR NEW CELL  The cell dirt work is hopeful to start this late summer/fall.

C.    CLOSURE OF RAVINE #5    Work on the four and half acres being closed will begin at the end of July or beginning of August.

UNFINISHED BUSINESS

A.     ALLIED WASTE   Liegois sent Allied Waste the information that they requested. Liegois heard back from Allied Waste that they would be looking at the material during this week.  .

Discussion on how do we move forward with operations, while we wait to hear from Allied Waste. If we were to sell, do we continue with our plans? Liegois told the board that the new landfill deadline has to be meet by October 2007.  A question was asked if other entities have interest in the agency. Liegois told the board yes, that several other companies have asked about the possible sell.

 

A question was asked if the agency even has the right to sell.  Liegois explained that the 28 E Agreement that was set up would need each entity involved vote on whether they would want to disband with selling of the landfill.  The DNR has told us that the liability on what is already closed, will not allow us to ever walk away with out being held liable.

 

Discussion was held on offering a contract rate to Allied Waste and if this has been done. Liegois said she did so earlier this year and then Allied Waste decided to move forward with coming to the agency about purchasing.  We need to make it advantageous for Allied to bring their garbage to the landfill because the garbage belongs here.  Allied originally approached us in March and they still have not made a decision.  Charlotte made a motion that we stop all talks of selling the landfill and begin looking at our other options.  Low Moor seconded the motion.  Roll call vote was taken

Motion failed with 22 yes and 28 no.

 

Clinton made a motion that we table the talks with Allied Waste and let them come to us when they want to talk or be put on the agenda.  Charlotte seconded the motion.  Motion unanimously carried.

 

 

NEW BUSINESS:

A.     BIDS RECEIVED FOR ADDITION TO RECYCLING Center

American Eagle Buildings Inc. - Annawan, IL  

$59,046.00 ( No electrical was included in this bid)

 

Payne & Associates, Inc. – Clinton, IA

$ 56,635.00 (This includes electrical)

 

River Service Co. – Maquoketa, IA

Adam Ebensberger – General Contractor – Clinton, IA

$46,686.00 (No electrical was included in this bid.)

 

Liegois recommended to the board that River Service Co receives the bid. Electrical will be added on later by a electrical contractor. Clinton made a motion that we accept the bid from River Service Co. for $46, 686.00. Delmar second the motion. Discussion followed concerning the electrical quotes and completion date if not met. Clinton amended the motion to: we accept the bid from River Service Co and the Liegois get electrical quotes and use her judgment on the electrical work. Delmar second the motion. Motion unanimously carried.

DeWitt made a motion that we adjourn until our next regularly scheduled meeting on August 10, 2006, at the Recycling Center at 6:30P.M.  Low Moor seconded the motion.  Motion unanimously carried.  Adjourned at 7:38 P.M.
